It does vary by state. it also varies by the type of water. We have WMA lakes, as well as those that are city owned, State owned, and US gov owned waters (like in a national park). The laws can be the same or different as well as different variations of each law.

On the page it states: "Fish caught by legal angling methods (such as bluegills caught by hook and line) may be used for bait."

Haven't ever fished out of state, but it is legal in Ohio as long there is no sign prohibiting live bait use of any kind.
I've heard that too Ben, and honestly I'm not sure if there's a statewide law in Ohio regarding this on public waters. I've only tried this tactic on private waters anyway, I guess I ought to check up on that in case I want to try it In public waters.
Great point, Adam. Be careful though, as I believe in some states (but not all) it is illegal to use any game fish as live bait. I ran into this question about a year ago and apparently if the official state fishing guide says nothing about it, then it is legal. If it is illegal in a state, then the state guide should specifically point it out. I was confused about this law at first because I could not find anything about it that outlaws it here, so I went browsing on some other message boards and finally found some info.
Pretty and healthy fish. Some folks might not like it here, but a small live bluegill is hard to beat for bass bait. I've also caught some nice channel cats on a small bluegill.
LOL! So, you hooked onto a 5" gill, and caught this 18" or so instead?
